Terms of Service

Effective October 31, 2026 · All policies

Plain-words summary. ArchOverflow is a set of tools for architects and designers, currently in private beta. Your work is yours. We host it, we don't sell it, and we don't train AI on it. The tools are planning aids, not stamped professional work. The service is free today and provided as-is while in beta. You can take your data and leave at any time.

1. Who we are, and agreeing to these terms

archoverflow.com and its subdomains (the "Services") are operated by Kyle Bigart, United States ("SuperJumbo", "we", "us"). If a corporate entity is formed to operate the Services, these terms will bind that entity as operator and this page will be updated.

By creating an account or using the Services you agree to these terms and to our Privacy Policy. If you use the Services on behalf of a firm or other organization, you represent that you have authority to bind it, and "you" includes that organization. If you don't agree, don't use the Services.

2. Private beta

The Services are in an invite-only private beta. That means, concretely:

3. Your account

You must be at least 16 years old. Keep your sign-in access to yourself; an account belongs to one person. Give us accurate information and keep your email current — it is how we reach you about your account and about changes to these terms. You are responsible for activity under your account.

4. Your content

"Your Content" means everything you create or upload in the Services — projects, documents, schedules, palettes, decks, images, and anything else that is yours.

5. AI features

Some features use machine-learning models to generate or transform content. Model output can be wrong, and you are responsible for reviewing anything it produces before relying on it. Your Content is sent to an AI provider only when you invoke an AI feature, and only to the providers listed on the Subprocessors page under the no-training terms described there.

6. Professional responsibility — read this one

The Services produce planning and design aids, not professional work product. Calculations and data surfaced by the tools — including areas, R-values, dew-point estimates, climate and weather-station data, schedule logic, and any code or standards references — are informational, may contain errors, and are not a substitute for the judgment of a licensed professional. Nothing in the Services constitutes architectural, engineering, legal, or financial advice. Any use of output on a real project must be independently verified, and remains the responsibility of, a qualified professional licensed in the applicable jurisdiction.

7. Acceptable use

Don't: use the Services for anything unlawful; upload content that infringes others' rights or is malicious (malware, phishing); probe, overload, or break the security of the Services or anyone else's data; circumvent rate limits or quotas; scrape the Services or resell access without our written agreement; or misrepresent who you are. We welcome good-faith security research — if you find a vulnerability, tell us privately at the contact below and give us reasonable time to fix it.

8. Termination

You can stop using the Services and delete your account at any time. We may suspend or terminate an account that violates these terms, creates risk for us or other users, or is required to be terminated by law; where practical we will warn you first and give you the chance to export Your Content. Sections 4 (your ownership), 9, 10, and 11 survive termination.

9. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that data will never be lost.

10. Limitation of liability

To the maximum extent permitted by law: we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, however caused and under any theory of liability, even if advised of the possibility. Our total aggregate liability for all claims relating to the Services is limited to the greater of US $50 or the amounts you paid us for the Services in the 12 months before the claim arose. Some jurisdictions don't allow certain limits; in those, these limits apply to the fullest extent permitted.

11. Indemnification

If you use the Services on behalf of an organization, that organization will defend and indemnify us against third-party claims arising from Your Content or your organization's use of the Services in violation of these terms.

12. Changes to these terms

We may update these terms. For material changes we will give notice — by email to your account address or prominently in the product — at least 14 days before they take effect (except where a change is required by law or addresses an urgent security issue). Continuing to use the Services after the effective date means you accept the updated terms. The current version always lives at this URL, and the effective date above tells you when it last changed.

13. Governing law and the rest

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules, and disputes belong to the state or federal courts located in New York. If any provision is found unenforceable, the rest stays in force; our failure to enforce a provision is not a waiver. These terms plus the policies they link to are the entire agreement between us about the Services.

14. Contact
