Media Policy

Introduction

This policy page is for all Media (or “Content”) presented on the website, and this page shall be read and applied in conjunction with the Terms of Service (TOS) and Privacy Policy of the Site. 

Media covered in this page includes, but is not limited to, inline images, diagrams, logos, technical drawings such as details, elevations, sections, data, information, and any other content that may be in graphic or written form. This also includes media that may be downloaded from Archoverflow, with or without our knowledge; in addition to any content that may be free or purchased.

1. Ownership and Release

The vast majority of Content (images, videos, diagrams, etc) are taken, created, or owned by Archoverflow and its contributors (the ‘Site’). All ownership is retained by Archoverflow and you are granted a license to use the media in compliance with this policy, and the Terms of Service. For any content that is externally referenced such as a piece of media re-posted with attribution from Reddit, or another public site, that content is subject to the referenced sites TOS and privacy policies. We claim no ownership over the content and have re-hosted it in an editorial or educational context.

2. Liability Release

All Content is provided “as-is” without any warranties or guarantees. You agree to download, view, reference, and use any Content at your sole risk; and will not make Archoverflow or any of its contributors liable in compliance with this policy as well as the TOS. The Content is provided without warranties or guarantees of fitness to any use with no verification of any accuracy. All information and content/media is provided for reference only.

By accessing and using the Site you agree to release Archoverflow and its contributors from direct or indirect damages arising from any errors in our Content. This includes due to the software, indirect or direct loss of profits or revenue, damages of any kind, inability to use the data, data corruption, loss of data, informational errors, errors or omissions, viruses, malware, or any other software issue.

You agree to release the Site and its contributors, and waive any and all claims, damages, liabilities, fees (including reasonable attorneys’ fees and defense costs) against the Site resulting in any way from any use of the Content.

Under no circumstances shall use of the Content from the Site by You be deemed a sale or publication by the Site, or constitute a relationship between the Site and You.

3. Content Use & License

Some of the Content on Archoverflow can be downloaded for free, without registration. Other content may be purchased. The purchased content in many cases is the same as the free content but in higher resolutions, better quality, without watermarks, etc. All content, free or purchased; must be used in compliance with this section’s requirements. See section #4 and #5 for further stipulations based on whether the content is free or purchased.

  • All commercial uses are limited to professional services. These commercial uses are defined as those individuals and companies that have been hired by someone to provide a Professional Service, such as design, architecture, engineering, lawyer, etc. Commercial uses such as reselling, hosting, sales, etc. are strictly prohibited regardless if purchased.
  • All content is provided as reference only. It is not intended to replace any professional services that may be required for successful execution of projects, details, construction, etc. At no point are we advertising ourselves as ‘your’ architect or ‘your’ designer.
  • You are not allowed to sell these images or profit from the direct or indirect sale of the media without written permission via email. Even if modified, repackaged, or altered in any way; you are not allowed to sell or license media provided to you by Archoverflow.
    • What this means (example): You cannot take any media from us, for example a diagram and alter it for another website or to be printed in a book, even if attribution is given.
    • What this means (example): You are not allowed to download a detail, adjust it slightly, then re-host or sell it to any one else, provide it in a book, etc; even if attribution is given.
  • You are not allowed to use any Content to try and build or create any Service, product, website, etc. that tries to directly or indirectly compete with Archoverflow and its intended audience.
  • Any other use that is not covered in the licenses and policy pages (media, TOS), requires the explicit written consent by Archoverflow.

4. Free Content

  • Attribution of images and content is always required. This attribution should link to Archoverflow and shall be large enough to be visible by the audience in the presentation format given.
    • What this means (example): You can use diagrams on the site for a client presentation if you are an Architect or Engineer or someone hired to provide Professional Licensed Services to a client. However, you must provide attribution on/near the diagram easy enough for the client/audience to see in the mode presented (video call, slide presentation, booklet, etc).
    • Some of the Content may be ‘watermarked’ with branding or identity. The watermark does not count as the required attribution.
  • Use in Professional Services Commercial Work, or personal work is completely royalty free. 
  • You are allowed to share Content directly to others with attribution via a direct link.
  • You are allowed to rehost single images and media for editorial commentary to another blog, with a direct link back to www.archoverflow.com. For 2 or more images or media used, reach out to us for written approval prior to publishing your article.
  • You are not allowed to download and organize/archive items on an external server for use later. All items must be deleted from a User’s computer directly after use.

5. Purchased Content (Licensed)

  • By purchasing the content, you are purchasing a license to use that content. Purchased content refers to content either monetarily paid for above $1 USD, or via a paying membership (not a ‘free’ membership).
  • You may use the content for Commercial purposes without need for attribution.
  • You are allowed to share Content directly to others without need for attribution.
  • You are allowed to rehost single images and media for editorial commentary to another blog, without attribution, so long as the editorial or blog complies with all other policies listed here and on other pages.
  • You are allowed to download multiple items and organize/archive them on an external server for your personal use later. Use is limited to those that have purchased the content.
  • The purchased content is for individual use and small office use only. Small office use is offices of 10 people or smaller, the single purchased use covers everyone in the office for use with that office only.
    • A licensed purchase is specific to each office/individual. A new license is required to be used at every office. The Content can be used on any number of projects.
    • A small office is defined as 10 full or part time employees or less. This is an employee regardless of whether they are designers, architects, licensed, human resources, accounting, contractor, etc.
